By accessing or using our Service, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Services

Booking Relay provides tailored Artificial Intelligence (AI) receptionist solutions designed for MedSpas. Our Service includes, but is not limited to, automated appointment scheduling and management, client inquiry responses via AI agents, and customized workflow integration.

3. Nature of AI Services (AI Disclaimer)

You acknowledge that the Service utilizes Artificial Intelligence. By using Booking Relay, you understand and accept the following provisions. No Medical Advice: The AI receptionist is an administrative tool only. It is not a medical professional and cannot provide medical diagnoses, treatment advice, or emergency triage. Accuracy: While we strive for high accuracy, AI technology is probabilistic and may occasionally generate incorrect or "hallucinated" information. You agree that Booking Relay is not liable for errors in booking details or communication nuances generated by the AI. Supervision: You are responsible for overseeing the AI’s interactions and verifying appointment details within your internal systems.

4. Client Responsibilities

To ensure the Service works effectively, you agree to the following obligations. You must provide accurate information regarding your MedSpa’s services, pricing, and availability. You must obtain all necessary consents from your patients/customers to have their data processed by a third-party AI provider, in accordance with local laws (e.g., GDPR, HIPAA). You agree not to use the Service for any unlawful purpose or to harass, mislead, or defraud users.

5. Fees and Payments

Subscription/Service Fees: Services are billed according to the plan selected in your Service Agreement or Invoice. Cancellations: You may cancel your service by providing 30 days' written notice. Refunds: Unless otherwise stated in your specific contract, all fees paid are non-refundable.

6. Intellectual Property

Our IP: Booking Relay retains all rights, title, and interest in our proprietary AI algorithms, software, code, and platform architecture. Your Data: You retain ownership of your patient lists, business data, and specific brand guidelines provided to us for training the AI.

7. Data Privacy and Security

We take data security seriously. We will process personal data only as required to provide the Service. Since we operate internationally, data may be processed in servers located in the United States of America. It is your responsibility to ensure your use of our Service complies with the data protection laws of your specific jurisdiction.

8. Limitation of Liability

To the fullest extent permitted by law, Booking Relay shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business reputation, arising out of your use of the Service. Our total liability for any claim shall not exceed the amount paid by you to us in the 3 months preceding the claim.

9. Service Availability

We strive for 24/7 availability but do not guarantee 100% uptime. Services may be temporarily unavailable due to maintenance, telecommunications failures, or force majeure events.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States of America and the specific State in which Booking Relay is registered. Any disputes arising under these Terms shall be resolved through binding arbitration or the courts located in the applicable jurisdiction within the United States.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or dashboard notification. Continued use of the Service constitutes acceptance of the updated Terms.

12. SMS/Messaging Terms

By consenting to Booking Relay’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Booking Relay through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders). Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the short code or phone number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. Help: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at 888-854-3011. Carrier Liability: Carriers are not liable for delayed or undelivered messages. Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages periodically based on your interaction with the service. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
